Chicago's Reckless Lawsuit Against Industry Dismissed

Today, Judge Stephen Schiller of Cook County Circuit Court
dismissed Chicago's reckless lawsuit against the firearms
industry, ruling that the city had failed to show that lawful gun
makers, distributers, and licensed dealers were in any way
responsible for the financial burden caused by the criminal
misuse of firearms. This ruling represents yet another blow to
the junk lawsuit agenda of anti-gun big-city mayors and the
greedy trial lawyers hoping to circumvent the policy process to
enact gun control restrictions in the courts.
Judge Schiller had
thrown out the city's "negligent entrustment" allegation earlier
this year (see FAX Alert Vol. 7, No. 6), and
today's ruling swept
out the remainder of Chicago's attempt to circumvent the
legislative process through frivolous litigation aimed at
bankrupting the gun industry.
Of course, if Chicago's elected
officials, such as Mayor Richard M. Daley (D), would focus their
crime-fighting efforts on criminals, rather than the lawful
firearms industry, perhaps Chicago would experience the same
rapidly-declining violent crime rate as cities that have
implemented programs like the "Project Exile" prosecution model.
Unfortunately, it would seem city officials wish to continue
wasting taxpayer dollars through the courts. According to today's
Chicago Tribune, a spokeswoman for the city has stated the case
will likely be appealed.
