"LEGISLATING BY LITIGATING"
STRUCK ANOTHER DAMAGING BLOW

"...Judge Schiller... enjoys an excellent reputation for his integrity, legal knowledge and ability. He is one of the hardest working jurists... dedicated to justice and fairness..."
-- Chicago Bar Association Judicial Review Program

Chicago's Mayor Daley

Cook County (Ill.) Circuit Judge Stephen Schiller has added to the growing failures of those trying to circumvent the legislative process through frivolous litigation aimed at bankrupting the gun industry.

Judge Schiller dismissed part of the city of Chicago's lawsuit against lawful gun makers, distributors and licensed dealers on Thur., 2/10, finding that the city's "negligent entrustment" allegation is meant to be used by private parties, not government entities. The judge also rejected the city's claim that gun manufacturers and dealers know or should have known their products would end up in the hands of criminals.

Of course, if Chicago's elected officials, such as Mayor Richard M. Daley (D), would focus their crime-fighting efforts on criminals, rather than the lawful firearms industry, perhaps Chicago would experience the same rapidly-declining violent crime rate as cities that have implemented programs like the "Project Exile" prosecution model.

Gun-ban extremists have experienced repeated judicial setbacks ever since they began to abuse our nation's courts to further their agenda of trying to abolish firearms in America. Last year, judges in Connecticut, Florida, and Ohio dismissed civil suits, one in each state, filed by municipalities against law-abiding firearms manufacturers (see FAX Alert Vol. 6, No. 39 & FAX Alert Vol. 6, No. 49).
